THE THREE KINGS & THEIR PRINCES(S)

"Larry Summers is ethically challenged."
   Former Economist Colleagues

Larry Summers and his Facebook Friends conspire to undermine U.S. "checks & balances" and take control of the world economy by stealth, we believe.

The persons pictured above and in the tables below helped Facebook steal the inventions of Columbus, Ohio USA innovator Michael McKibben and Leader Technologies, Inc. Leader proved in federal court that Facebook is guilty on 11 of 11 counts of infringing Leader’s U.S. Pat. No. 7,139,761. This means that the engine running Facebook is stolen. However, when Leader turned to the federal courts to protect their property rights, the Judicial and Executive Branches turned a blind eye and actually supported the thieves. The story is both sad and frightening.[1]

Obstruction of justice. Judges, including the Chief Justice of the Supreme Court,[57] failing to disclose stock in Facebook, not even counting family investments. Twenty-eight of Zuckerberg’s hard drives purported to be lost, then “found” after the Leader v. Facebook trial. A political machine protecting 47 million Obama “likes” on Facebook. Fabricated evidence. Doctored dockets. Affirmation of a laughable expert. Affirmation of a fumbling appeal argument. Undisclosed court professional relationships with Facebook's attorneys and principals. Sudden and unprecedented wholesale reversals at the Patent Office by a former Microsoft employee now patent judge. The Patent Office claiming Executive Privilege in a FOIA request. Mountains of ignored precedential law. Redefining the meaning of "is." Breaches of due process. The list goes on.

American institutions corrupted by the Facebook cabal

If average American citizens do not raise their voices now to support fundamental American property rights—and oppose this corruption—then whose property will be taken next with the blessing of an increasingly lawless federal bureaucracy?

What will you do about it? Waiting for someone with more ability, time, contacts, power and position is the definition of apathy. When good people do nothing, their country and society end up on the dust heap of history. Is that the legacy you wish to leave your children and grandchildren? If it is not, contact your representatives, senators and media with this information. Speak about it in your school, university, church, synagogue, mosque and civic gatherings. Our property and privacy rights are eroding rapidly in this wholesale attack on our laws by our lawyers themselves.

Attorney Warning Sign

Some of the people in this rogues gallery are the ringleaders, others are willing grunts (like Zuckerberg), others were bribed or blackmailed, others are just weak, and still others were sucked in. Help us sort them out. We encourage anyone in this gallery to go to the Committee on Oversight & Government Reform and offer your testimony. Perhaps you can ask for immunity when you tell the truth.

Sixty-one (61%) percent of the people in the first list are attorneys, sworn to uphold American justice. They have done the opposite. One hundred (100%) percent of the USPTO people are attorneys. The probable ringleaders are designated with a  teal  background.  Yellow  background shows Leader v. Facebook judges and family that are known or suspected of holding Facebook stock. Note that when asked to disclose their holdings and those of their immediate families, the Federal Circuit judges refused to disclose their holdings en masse. The Code of Conduct for U.S. Judges requires such disclosure to the public as an essential element of transparency and accountability to the public.

Patent Office Corruption Watch:

USPTO FOIA, Kathryn Siehndel, Response F-13-000064, Jan. 29, 2013

The Patent Office recently claimed "executive communication privilege" in  a Freedom of Information Act (FOIA) request regarding Leader v. Facebook. This means the Patent Office is refusing to explain why President Obama is involved in this matter. This follows a remand, approved by the Director’s Office (an Obama political appointee), for an unprecedented third patent reexamination, hastily ordered and improperly written with no instructions to the examiner. Many believe this action is politically movitated—to protect President Obama’s 47 million "likes" on Facebook. See "Patent Office Impropriety" sidebar showing p. 35. U.S. Patent Office FOIA, Kathryn Siehndel, Response F-13-000064, Jan. 29, 2013.[54]

It is notoriously known that President Obama’s Facebook relationships helped secure his election, and the Democratic Party is gearing up to use this benefit for  Hillary Clinton in 2014. These Leader patent claims have withstood a decade of scrutiny, and have been affirmed three times. This latest wholesale reversal of the Leader claims has the strong odor of corruption.

Attorney Warning Sign

Enough suspicion exists to create a corruption watch list. That suspicion is heightened by the revelation several days ago that Patent Office FOIA counsel Kathryn W. Siehndel is a former employee of Facebook’s attorney, White & Case LLP. White & Case LLP filed the first Facebook reexamination request. Despite this evident conflict, Ms. Siehndel has been responding to FOIA requests as if she is not biased, and without informing the requester of her conflict of interest. It would appear that the Patent Office is pulling out all the stops to protect Facebook. Therefore, we mark appearances of impropriety with an alert "!" sign. We only know some of the judges and personnel who handled the Leader reexaminations (gleaned from the recent FOIA). Therefore, the connections between the Patent Office judges and Facebook are suspected, but further verification is sought.

We also need to know if any of these judges, or their families to the "third degree of relationship," hold Facebook stock related to the Facebook IPO. 28 USC § 455(b)(5).[30] This would include stock in companies with notorious relationships to Facebook's second largest shareholder, James W. Beyer and Accel Partners LLP; companies like Microsoft, Fidelity Funds, T. Rowe Price Funds, and Vanguard Funds.

Note that U.S. Patent Office judges are administrative judges, since the Patent Office is under the executive branch of government, not the judicial branch. However, these judges are still compelled to follow the Code of Conduct that requires them to disclose conflicts of interests that may arise in the course of their patent examinations.

The Sixth Circuit in American Cyanamid Company v. FTC, 363 F. 2d 757 (1966) at 767, 768 vacated an administrative order and decision of the Federal Trade Commission regarding an American Cyanamid patent due to administrative bias stating:[31]

"[W]e therefore must vacate the order and decision of the Federal Trade Commission and remand the case for a de novo consideration of the record without the participation of Chairman Dixon . . .  Litigants are entitled to an impartial tribunal  whether it consists of one man or twenty and there is no way which we may know of whereby the influence of one upon the others can be quantitatively measured." (emphasis added).

The Canon 2 of the Code of Conduct for United States Judges[55] (and similar sections of the Standards of Ethical Conduct for Employees of the Executive Branch[56]) which oversees the Patent Office,] instructs judges and judicial employees, including clerks, to:

Patent Judge Stephen C. Siu failed to disclose his conflicts of interest in the Leader v. Facebook matter. Two Facebook stakeholders, Microsoft and IBM, are his former employers

"Avoid impropriety and the appearance of impropriety in all activities."

The conduct of Judge Stephen C. Siu and his U.S. Patent Office colleagues in Leader v. Facebook stinks, even if it is not rotten. Either way, he had an ethical duty to disqualify himself, instead of secretly leading the charge in a naked patent grab by Facebook and Facebook's Friends Microsoft and IBM, his former employers.

Likewise, Leader Technologies has no way of quantifying the pro-Facebook sentiments at play among the large number of USPTO judges and personnel with vested interests in decisions favorable to Facebook.

The following are just some of the moral and ethical standards that should be guiding our elected officials and public bureaucrats:

  1. U.S. Constitution
  2. U.S. Bill of Rights
  3. Rules of Professional Conduct
  4. Federal Rules of Civil Procedure
  5. Standards of Ethical Conduct for Employees of the Executive Branch
  6. Entire Fairness Standard
  7. Business Judgment Rule
  8. The Ten Commandments ("You shall not steal." "You shall not lie.")
  9. Golden Rule (Treat others like you would like to be treated.)
  10. Common Decency

President John Adams observed that no written Constitution of government can work if the citizens are not first a moral and religious people. In other words, unless the citizens agree on and adhere to a basic set of personal character principles. The U.S. Constitution was never intended to be a moral standard. Rather, it was written to protect privacy and property from an intrusive state. The Constitution relies on The Ten Commandments, the Golden Rule and Common Decency for moral principles.

Evident Leader v. Facebook Conflicts of Interest:

Attorney Warning Sign

Judge Stephen C. Siu[32] is a former Microsoft and IBM employee. Since David J. Kappos is former Chief Counsel for IBM, the influence is evident. Also, Microsoft is one of Facebook's largest shareholders and benefits greatly from decisions favorable to Facebook. Also suspicous is the central organizing role that Judge Siu played in preparing the Patent Office response to the recent FOIA request. He should have recused himself due to the appearance of improriety.  Therefore, he has tainted the entire proceeding with evident judge bias.

Attorney Warning Sign

James R. Hughes,[33] Meredith C. Petravick,[34] James T. Moore[35] and Alan R. MacDonald[36] handle the Leader Reexamination with Judge Stephen C. Siu. Therefore, since they are turning a blind eye to propriety, their perspectives are corrupted and partial by default.

Attorney Warning Sign

Judge Jackie W. Bonilla[37] is a former clerk for Federal Circuit Chief Judge Randall R. Rader. Given the evident judge bias in Rader’s court in Leader v. Facebook, he now has a personal interest in helping Facebook achieve its objectives at the Patent Office. His panel of three judges in Leader v. Facebook (Judge Kimberly A. Moore, Judge Evan J. Wallach and Judge Alan D. Lourie) each held stock in Facebook during the proceedings. Therefore, decisions favorable to Facebook help his judges’ individual stock portfolios. Rader’s court also refused to disclose financial conflicts of interest when asked.

Attorney Warning Sign

Judge Jason V. Morgan[38] is a former Microsoft intern. His relationship with Microsoft at least deserves disclosure and recusal.

Attorney Warning Sign

Judge Mike Strauss[39] recently worked for Verisign (2010-2011). Verisign is notoriously associated with Accel Partners LLP and Fenwick & West LLP. Accel Partners is Facebook's second largest shareholder. Fenwick & West LLP is Facebook’s securities and patent counsel. In fact, during Strauss' tenure at Verisign, the Indian operations director for Verisign joined Accel Partners LLP See Archana Rai, "Verisign India chief joins VC firm Accel." The Indian Economic Times, Jan. 26, 2011 <http://articles.economictimes.indiatimes.com/2011-01-26/news/28425434_1_venture-capital-canaan-partners-early-stage-fund>.[40] This conflict is enormous.

Attorney Warning Sign

Judges George Best,[41] Lynne Pettigrew,[42] Bart A. Gerstenblith ,[43] Dave McKone[44] and Jennifer B. Bisk[45] were each clerks to Federal Circuit judges who declined to hear Leader Technologies’ petition for rehearing. George Best and Jackie W. Bonilla clerked for Chief Judge Randall R. Rader. The evidence of widespread judge bias at the Federal Circuit now taints all connections to the judges. These clerks very likely continue to be loyal to their former bosses, and cannot therefore be impartial.

Attorney Warning Sign

Judge Kit Crumbley[46] worked at the Department of Justice, which is being advised by Donald K. Stern of Cooley Godward LLP. Cooley is Facebook’s attorney in Leader v. Facebook, and might try to rely upon Crumbley’s continuing loyalties to his former employer; therefore hecannot be impartial.

Attorney Warning Sign

Kathryn W. Siehndel,[47] US Patent Office, FOIA Counsel claimed “executive communication privilege” in a recent FOIA request. We have just learned that Ms. Siehndel failed to disclose that she has a conflict of interest in Leader v. Facebook. A recent former employer is White & Case LLP which is one of Facebook law firms. Heidi Keefe and Mark Weinstein now at Cooley Godward LLP, and Samuel O’Rourke now at Facebook as inside intellectual property counsel, were all at White & Case LLP with Ms. Siehndel.

Attorney Warning Sign

Judge Stacey White[48] has direct prior professional relationships with Gibson Dunn Crutcher LLP, including with  Cobra Legal Services and its employees and owners, namely Laura (Ewing-Moore) Ewing-Pearle[49] and Judge Cantwell F. Muckenfuss III,[50] who is also a partner at Gibson Dunn LLP. Since Gibson Dunn is Facebook’s appeals attorney, any involvement or influence by Judge White requires disclosure and likely recusal due to lack of impartiality.

Attorney Warning Sign

Judge Catherine Timm[51] is responsible for reviewing twice rejected patent reexamination requests, like Facebook’s. A close eye needs to be kept on Ms. Timm to see if she continues to sustain her unprecedented wholesale reversal in this third Facebook reexamination request.

Attorney Warning Sign

Judge Hung J. Jung[52] worked at Blank Rome LLP, another of Facebook’s attorneys in Leader v. Facebook. He worked there between Sep. 2006 and March 2010. This was during most of the pretrial discovery when Facebook’s Cooley Godward LLP, White & Case LLP and Gibson Dunn LLP discovery misconduct was occuring (concealing the existence of 28 Zuckerberg hard drives from Leader Technologies’ attorneys).

F. WEIL GOTSHAL LLP
Filed motion for Federal Circuit Bar Assoc. in favor of Facebook; Judge Kimberly A. Moore's former client; Judge Moore holds stock in Facebook, as do Judges Alan D. Lourie and Evan J. Wallach.

G. U.S. JUSTICE DEPARTMENT
Facebook's counsel Donald K. Stern, Cooley Godward LLP, is Obama's Justice Dept. "Transition Advisor;" Patent judge Kit Crumbley was employed by the Department of Justice, giving Donald K. Stern access.

H. FEDERAL CIRCUIT CLERK FOR JUDGE . . .
Judges for which Patent Office judges clerked are Randall R. Rader (twice), Richard Linn, S. Jay Plager, William C. Bryson, Sharon Prost, and Paul R. Michel.

I. FEDERAL CIRCUIT CLERK OF COURT
Jan Horbaly.

J. IBM
David J. Kappos, USPTO Director; former IBM Chief IP Counsel; IBM sold 750 patents to Facebook during Leader v. Facebook; Judge Stephen C. Siu is a former employee of IBM.

K. MICROSOFT
Director of Federal Circuit Bar Association (FCBA); Clerk of Court Jan Horbaly is an FCBA officer; major Facebook stockholder; stock held by every judge in Leader v. Facebook panel; Judge Stephen C. Siu is a former employee of Microsoft; Judge Jason V. Morgan is a former intern.

L. ACCEL PARTNERS LLP
Facebook shareholders James W. Breyer, Jim Swartz, Ping Li are the 3rd largest stockholders in Facebook; partnered with Microsoft and IBM; represented by Latham & Watkins LLP, Matthew J. Moore's firm; represented by Weil Gotshal LLP who represented the FCBA in Leader v. Facebook; partnered with Fidelity Investments and Rob Ketterson; Judge Kimberly A. Moore, Judge Evan J. Wallach, Judge Alan D. Lourie, Chief Justice John Roberts and Judge Leonard P. Stark hold up to 11 Fidelity, T. Rowe Price and Vangaurd funds with notorious holdings in Facebook and associated companies.

M. FENWICK & WEST LLP
Facebook securities & patent counsel, Gordon K. Davidson, is Leader Technologies' former counsel; Fenwick handles much of Facebook's patent prosecution work at the Patent Office and has engaged in egregious inequitable conduct by not disclosing Leader U.S. Patent No. 7,139,761 in Facebook and Zuckerberg's prior art disclosures; Fenwick's securities work to obtain the 12(g) exemption then take Facebook public directly benefits the Leader v. Facebook judges' personal financial portfolios; all the judges stood to benefit personal by decisions favorable to Facebook.

N. FACEBOOK
Samuel O'Rourke and Craig W. Clark, formerly with White & Case LLP, are now IP Counsels at Facebook; James W. Breyer / Accel Partners is a Facebook director.

O. A.F.L.C.T.A.C.A.F.C.
(Assoc. of Former Law Clerks and Technical Assistants for the United States Court of Appeals for the Federal Circuit) [This is not a joke. This is the full name of this organization.] Facebook attorneys and friendlies, including Jan Horbaly, Microsoft, Weil Gotshal LLP, Fenwick & West LLP, Gibson Dunn LLP, Orrick Herrington LLP and Latham & Watkins LLP have influence in this body which is populated with patent judges.

P. PERKINS COIE LLP
Operates a paramilitary "rapid response enforcement team" for Facebook and President Obama, according to partner Joseph P. Cutler's professional biography.[61] Thier long-time partners, Robert F. Bauer and his wife Anita B. Dunn, were discovered to have directed the IRS targeting of the Tea Party as President Obama's personal counsels. Their direction of the judicial misconduct and the corrupting of the federal courts in Leader Technologies, Inc. v. Facebook, Inc., 08-cv-862-JJF-LPS (D.Del. 2008) seems all but certain since the U.S. Patent Officer recently claimed executive privilege in refusing to turn over documents in a Freedom of Information Act (FOIA) Request. Also complicit in these illegal acts are other Perkins Coie LLP partners, namely Joseph P. Cutler, David P. Chiappetta, James (Jim) R. McCullagh, Ramsey M. Al-Salam and Grant E. Kinsel.

What do these judges know about the Leader v. Facebook misconduct? When did they know it?

The Three Monkeys

The Rules of Professional Conduct require attorneys to report misconduct, and not simply "turn a blind eye." Withholding knowledge of misconduct is a serious ethics violation. Misbehaving attorneys and judges need to be ousted from the profession. With less "three monkeys" conduct (speak no evil, see no evil, hear no evil), perhaps our justice system would improve. Did you know that the DC Bar Association says federal judges are immune from disciplinary investigation and action, even for criminal acts? Who made that rule? This is a monarchical privilege that was expressly repudiated by the U.S. Constitution. The judiciary derives its authority and power from the people, just like all other branches of government. That authority has run amok.

A license to practice law is a privilege, not a right. Attorneys swear a solemn public oath not to simply conduct themselves like The Three Monkeys in their associations with other attorneys who are acting improperly, judges or not.

Tar & Feathers . . . when politicians, bureacrats, attorneys and financiers stop showing respect for the U.S. Constitution

We were intrigued by the name Tar & Feathers, so we found several histories:

Here’s one contained in a Mormon history: John Kimball Alexander. TARRED AND FEATHERED: MORMONS, MEMORY, AND RITUAL VIOLENCE. University of Utah Master’s Thesis, August 2012. Accessed June 27, 2013 <http://content.lib.utah.edu/utils/getfile/collection/etd3/id/1121/filename/1117.pdf>.

Benjamin H. Irvin. Essay: "Tar and Feathers in Revolutionary America." Brandeis University, undated. Accessed June 27, 2013 <http://revolution.h-net.msu.edu/essays/irvin.feathers.html>.

Tarring and feathering. Wikipedia. Accessed June 27, 2013 <http://en.wikipedia.org/wiki/Tarring_and_feathering>.

Tarring and feathering appears to have emerged in early America to address the lack of laws appropriate for the young democracy. Now we have mountains of laws that our judges are not following. Has our legal system thus become so burdened with inexcusable privilege that it now resembles the stagnant laws of King George? Is the American citizenry being forced to consider the extra-legal tactics of earlier times to correct the injustices being perpetrated by corrupt lawyers and judges? Intriguing.

Conflicts Alert!

Former Clerks of the Federal Circuit are networked through the Association of Former Federal Circuit Law Clerks (AFLCTACAFC). Therefore, the coziness and influence among the paid professional legal bureaucrats in Washington among the "checks and balances" branches of government never stops. This group essentially forms a Fifth Column within the U.S. Patent Office to promote the Federal Circuit agenda. Therefore, one can reasonably assume that all the former clerks are biased on matters coming to them from the Federal Circuit, as has occurred in this 3rd patent reexamination in Leader v. Facebook.  Arguably, this association taints all of their rulings.  This appears to be how the "old boys" corrupt their profession.

OPINION NOTICE: This document may contain opinion. As with all opinion, it should not be relied upon without independent verification. Think for yourself. What you are being told by these people is often a fabrication designed for effect only and meant to protect the agenda at the expense of the truth. In fact, these people practice a cynical form of neuvo-Orwellianism in all their language and rhetoric. Nothing is what it seems.
